Terms of Use
Mind The Gift is a free service that helps you find gift ideas. You buy from the retailer, not from us. These terms explain how you can use the service and our responsibilities to each other.
1. Who we are
The service at mindthegift.co.uk and app.mindthegift.co.uk is operated by Mind The Gift Ltd, registered in England and Wales, company number 17314078. Our registered office is 50 Princes Street, Ipswich, IP1 1RJ. Contact hello@mindthegift.co.uk.
2. Using the service
The service is for adults aged 18 and over and is designed for UK users. Please read these terms before using it. By using the service, you agree to these terms. If you do not agree, please do not use it.
You do not need an account. Saved dates and reminder emails are not offered as part of the guest gift search. The gift search does not require an account. A small number of accounts exist from earlier testing and do not currently unlock any additional feature.
3. Gift suggestions and retailer purchases
We suggest products and experiences from a selected catalogue using your answers. We do not search the whole market or promise that a suggestion is the cheapest, best or right for every recipient.
We do not sell, take payment for or fulfil the gifts shown. If you buy, the purchase contract is with the retailer. Its terms cover the purchase, delivery, cancellations, returns and refunds, alongside your statutory rights. Contact the retailer about an order.

4. AI and product information
AI helps interpret interests and write explanations. Our matching rules select and order gifts using your answers and the resulting tags. Explanations can contain mistakes and are not customer reviews.
Prices, stock, descriptions and delivery information can change. Before buying, check the retailer's current product details, total price, delivery terms and any safety or age restrictions. If you spot an error on Mind The Gift, please tell us so we can investigate.
Delivery badges and Emergency Mode help you look for options suited to your deadline. They do not guarantee arrival. Check the delivery date, cut-off time, location restrictions and any voucher activation requirements with the retailer.
5. Affiliate links
Some links are advertising links. If you buy through a link marked “Ad · affiliate link”, we may earn a commission. We do not charge you a fee for using that link. The retailer sets the price and any offers.

6. Using the service fairly
Please do not use the service unlawfully, attempt unauthorised access, interfere with its security, submit malicious content or deliberately overload it. Do not systematically extract or reuse protected content without permission where the law requires permission.
Keep search answers to gift preferences. Do not submit names, contact details or sensitive information about yourself or anyone else. We may limit requests to protect the service and its availability.
7. Content and feedback
Our branding, original content and software belong to us or our licensors. Retailer names, images and other third-party content belong to their respective owners. You may use the service to choose and share gift ideas for personal, non-commercial purposes.
You retain any rights you have in the information you submit. You permit us to use it to provide the service you request and handle your feedback, in accordance with the Privacy Policy. This permission does not override data protection law. We will not publish feedback that identifies you as an endorsement without your permission.
8. Availability and changes
We aim to keep the service available, but interruptions and errors can occur. We may change or withdraw features, including for maintenance, security or legal reasons. Where practical, we will give reasonable notice of a change that materially affects your use.
We may restrict access where reasonably necessary to address misuse or a security risk. You can stop using the service at any time.
9. Our responsibility to you
Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded or limited. Your statutory rights as a consumer are not affected.
We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. Loss or damage is foreseeable if it was an obvious consequence or was contemplated by both you and us when you used the service.
Subject to the exceptions in this section, our total liability to each user for ordinary financial loss arising from any one incident attributable to our service is limited to £1,000. This is a separate limit for each affected user, not a single limit shared between users.
The £1,000 limit does not apply to claims concerning privacy or data protection, or to any liability identified in the first paragraph of this section that cannot lawfully be excluded or limited.
The retailer is responsible for performing your purchase contract. That does not remove our responsibility for our own actions, statements or failures where the law makes us responsible.
The service is provided for personal, non-commercial use. If you use it for business purposes, we are not liable for business losses such as lost profit, revenue or business opportunity, to the extent the law permits.
10. Complaints
If something has gone wrong with our service, email hello@mindthegift.co.uk and explain what happened. For privacy complaints, use privacy@mindthegift.co.uk; the process is in our Privacy Policy.
11. Changes to these terms
We may update these terms for future use of the service. We will show the updated date and make material changes clear where appropriate. Changes will not retrospectively remove rights or claims you already have.
12. Law and courts
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you retain the benefit of mandatory consumer protections applicable where you live and may bring proceedings in your local courts. Nothing here restricts a court or legal remedy available to you under mandatory consumer law.
If part of these terms cannot be enforced, the remaining parts continue to apply so far as the law permits.
